The terms “you”, “your”, and “yours” refer to anyone accessing, viewing, browsing, visiting or using the Site. The terms “orgnxeliquids.com”, “we”, “us”, and “our” refer to orgnxeliquids.com, its affiliates, and subsidiaries. We reserve the right to change the nature of this relationship at any time and to revise these Terms and Conditions from time to time as we see fit. As such, you should check these Terms and Conditions periodically. Changes will not apply to any orders we have already accepted unless the law requires. If you violate any of the terms of these Terms and Conditions, you will have your access canceled, and you may be permanently banned from accessing, viewing, browsing and using the Site. Accessing, viewing, browsing and using the Site after we post changes to these Terms and Conditions constitutes your acceptance and agreement to those changes, whether or not you reviewed them. At the bottom of this page, we will notify you of the date these Terms and Conditions were last updated.

ORGNX Eliquid, Inc. and other marks which may or may not be designated on the Site by a “™” “®” “SM” or other similar designation, are registered, pending or unregistered trademarks or service marks of ORGNX Eliquid, Inc., in the United States and other countries. Our graphics, logos, page headers, button icons, scripts, and service names are trademarks or trade dress of ORGNX Eliquid, Inc. ORGNX Eliquids trademarks and trade dress may not be used in connection with any product or service that is not ORGNX Eliquid’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits ORGNX Eliquids. All other trademarks not owned by us that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by ORGNX Eliquid, Inc.

Site Access

You may not download (other than page caching) or modify the Site or any portion of it without our express, prior written consent. You agree to accept responsibility for all activities that occur under “My Account” or password. We reserve the right to refuse service, terminate accounts and to remove or edit content submitted by you in the “My Account” area of the Site.

Notwithstanding the preceding, neither ORGNX Eliquids nor its Associates can ensure prompt removal of questionable Content after online posting. Accordingly, neither ORGNX Eliquid, Inc., nor its Associates assume any liability for any action or inaction on conduct, communication, or Content on the Site.

Social Media Policy

When you post or upload any content to any ORGNX Eliquids social media page, you agree that ORGNX Eliquids can use that content, including any names, voices, images and performances that content contains, for any purpose. By posting or uploading the content on a ORGNX Eliquids page, you grant the ORGNX Eliquids a perpetual, non-exclusive, irrevocable, fully paid, royalty-free, sub-licensable and transferable worldwide license in any and all media to use, modify and create derivative works based upon that content for any purpose, including advertising and promotion, without notice, attribution or payment. You certify that you are the original author or creator of your content and that you have the right to post it. You also confirm that you have permission from anyone depicted in a photograph you post to agree to these terms and that ORGNX Eliquid’s use of your content by this license will not violate or infringe upon anyone else’s rights. ORGNX Eliquids does not tolerate misleading/inaccurate content and content containing racial, ethnic, sexual, religious or physical disability slurs. Accordingly, we reserve the right to edit and delete such content.

Termination of Usage

We may terminate your access or suspend your right to access to all or part of the Site, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law, is in breach of these Terms and Conditions or is harmful to the interests of other users, Associates, or us. Also, we reserve the right to refuse an order from any customer in our sole discretion.

Usage by Minors

This Site is not intended for or directed to persons who are minors (typically persons under the age of 18, depending on where you live). Because we cannot prohibit minors from accessing, viewing, browsing, visiting or using the Site, we must rely on parents, guardians and those responsible for supervising minors to decide which materials are appropriate for minors to view and purchase. Site Policies, Modification & Severability

Please review our other policies, such as our Privacy and Security Policy, Returns Policy, Shipping & Delivery Policy and others, all of which are incorporated herein by this reference and are posted on the Site. These policies also govern your visit to the Site. We reserve the right to make changes to the Site, policies, and these Terms and Conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

How to Order Through Our Site

After placing an order, you will receive an email from us acknowledging that we have received your order (“Order Confirmation”). Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email confirming the shipment of your order (the “Shipping Confirmation”). A contract with us will only be formed when we send you the Shipping Confirmation. The contract will relate only to those products whose shipment we have confirmed in the Shipping Confirmation. We will not be obliged to supply any other products which may have been part of your order in a separate Order Confirmation. We reserve the right to cancel your order at any time before we have accepted it, and we may rescind our acceptance and cancel your order where there has been a clear error in price or where the product is no longer in our or our inventory. This applies only to items available in our online store. Eliquid products are not on sale through our online e-commerce platform.

Order Change Policy

Orders at ORGNX Eliquids are typically turned around very quickly, and your packing slip is usually generated within 20 minutes of placing your order. Once this packing slip is made, your order has begun the shipment process of picking, packing, and staging. We will do our best to accommodate change requests within this 20-minute time frame, but will be unable to fulfill requests outside of that window. This policy is in place to ensure customers receive their orders as quickly as possible.

Return Policy

Eliquid:

Unfortunately, we are not able to accept returns on Eliquid that does not meet personal flavor expectations. Taste is a very subjective sense that will vary greatly from person to person. By our strict Quality Control guidelines, returned Eliquid could never be re-used for any purpose, so will not be accepted.

Promotional items and apparel:

If you’re not satisfied with your purchase of ORGNX Eliquids products, you can return it for a full exchange or refund within 30 days of receipt. Please inquire and send a request.

Pricing and Availability of Products

Prices and availability of products on the Site are subject to change without notice. Errors will be corrected when discovered. Our Site contains a large number of products, and it is always possible that, despite our best efforts, some of the products listed on our Site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a product’s correct price is less than our stated price, we will charge the lower amount when dispatching the Product to you. If a product’s correct price is higher than the price stated on our Site, we will normally, at our discretion, either contact you for instructions before dispatching

On occasion, you may be able to place a product in your shopping cart and submit your order for processing, but your order is subsequently canceled due to unavailability of product. You acknowledge that products may sell quickly, and there may be a short period after an order has been submitted, but where the product is no longer available. You agree that we may cancel your order after you have received an Order Confirmation without penalty.

On very rare occasions, you may receive a Shipping Confirmation from us, but the product is no longer available in our inventory. You agree that we may rescind our acceptance and cancel your order without penalty if we are unable to ship the product you ordered due to unavailability.

Coupons and Promotions

ORGNX Eliquids may offer both coupons and promotions. The coupons and promotions are subject to the following terms: Coupons must be entered at the point-of-sale for discount to be applied; Coupons cannot be retroactively applied to existing orders; Promotional offers cannot be used with other discounts or coupons; Coupons and promotions are not applicable to Clearance items.

Free Samples

While supplies last. ORGNX Eliquids reserve the right to discontinue this promotion at any time without notice. The number of free samples, product flavors, and bottle sizes will be determined by ORGNX Eliquids, in its sole discretion, at the time of shipping your qualifying order. Free samples cannot be returned or exchanged. Any samples are provided “as is” without warranty of any kind. Other terms and conditions may apply.

General Disclaimer

Offer limited to those individuals who are of legal age to purchase and use our products under applicable law. All offers are limited to stock on hand; no rain checks are available. Shipping

The term shipping or ship includes the commencement of shipping items for multiple purchases or where the item purchased consists of components that must be shipped separately. For example, your order may consist of (1) several different items, (2) a quantity of the same item, or, (3) a single item with several parts the size of which might require them to be shipped in separate packages. In all such orders, we endeavor to ship out individual packages together so that they arrive at the same time; however, when that is not possible, we commence by shipping individual packages in the order they are available, and conditions permit. In these instances, our notification to you that your order has “shipped”, marks the time when shipping has commenced; it does not mean that all items in the order have shipped at that point. You agree that credit cards and debit cards are to be charged on the date of inventory reservation for the order, not the date of shipping.

Risk of Loss

All items purchased from ORGNX Eliquids are made under a shipment contract. This means that the risk of loss and title for such items pass to you upon tender of the item to the carrier.

Delivery Times

Your order will be fulfilled by the delivery date set out in the Shipping Confirmation or, if no delivery date is specified, then within a reasonable time of the time of the Shipping Confirmation, which could in exceptional circumstances be longer than 30 days.
